Adjustment of ergonomics RD can count on positive opinion of Supreme Court

The draft RD on ergonomics and prevention of musculoskeletal disorders (MSD) receives a positive opinion from the Supreme Court for Prevention and Protection at Work. What are the most important elements of the opinion?
 

A large number of employees struggle with long-term musculoskeletal disorders. The draft RD therefore wants to amend book VIII of the well-being at work codex - on ergonomics and the prevention of musculoskeletal disorders. 

The signing of the royal decree is scheduled for 15 May. In concrete terms, it will come into effect ten days later – on 25 May.

Positive advice

The Supreme Court responds positively to the amendments of the draft RD, which seeks to create a complete legal framework for MSD prevention.

The most important points are as follows:

  • Further clarification of terminology and definitions, such as the role of the prevention advisor-ergonomist and other experts;
  • Ergonomic requirements must not compromise occupational health and safety;
  • Regular updates and reviews of risk assessments and prevention measures are recommended, and should be conducted through a multidisciplinary lens.

Increased focus on ergonomics

Gerrit Pollentier, Ergonomics Manager at Mensura: "The adjustments proposed by the RD and the additional opinions of the Supreme Court are a positive development: it further strengthens the focus on ergonomics and prevention of MSDs. The requirement for ergonomics risk assessment is not new, but the legislation will now apply to all ergonomic risks, and not just screens, manual handling of loads and standing work."

"What is also new is that any new design or modification to the workstation will require attention to ergonomics. This is a good thing, as it maximises the impact of ergonomic advice, as in other welfare domains."

"When certain analyses involve too much complexity or do not have the right competence present internally, the employer should involve the prevention advisor-ergonomist. This may apply to design advice as well as to specific and solution-oriented risk analyses.
