What’s the difference between an assistance contract and a replacement contract for a risk prevention advisor?

Assistance contract 

  • Your internal risk prevention advisor is assisted by an external advisor from Mensura. 

  • Your internal advisor retains responsibility for the various tasks. 

  • These tasks include advice, drawing up documents, risk assessments and support in specific areas of expertise. 

  • You determine the frequency of the support in consultation with Mensura. 

Replacement contract 

  • The external risk prevention advisor temporarily takes over a number of tasks from your internal advisor, for example in the event of long-term absence (illness, maternity leave, etc.). 

  • The  external replacement also temporarily fulfils the internal advisor’s legally required tasks. 

  • The frequency depends on the time allocation suggested by Mensura.

Who retains responsibility for the risk prevention policy when assistance is provided?

The  final responsibility always lies with you as the employer. The internal risk prevention advisor carries out the legally required tasks, such as drawing up reports, participating in the Committee for Prevention and Protection at Work (CPPW) and providing advice. 

The external advisor gives support and advice, but doesn’t assume any legal responsibilities.

When should you engage an external risk prevention advisor to support the internal risk prevention advisor?

You should engage an external risk prevention advisor if the internal risk prevention advisor lacks the time, knowledge or resources to perform certain tasks alone. That could include risk assessments, developing a General Risk Prevention Plan, supporting work accident investigations or assisting with audits. 

You can engage the external risk prevention advisor temporarily for a specific task, or for a longer period to provide systematic support with various tasks.
